DEMING – Former Western New Mexico University President Joseph Shepard is denying allegations that he misused public funds intended for an ADA-accessible ramp to build a patio and walkway for his daughter’s wedding.
The New Mexico State Ethics Commission has filed a lawsuit accusing Shepard of violating the Governmental Conduct Act and redirecting more than $177,000 originally set aside for accessibility improvements at WNMU’s “502 property,” located next to the university president’s home.
Shepard responded to the claims in an interview with KOAT-TV, stating, “No money was used for my daughter’s wedding. No money was taken from ADA. No money was taken from anywhere.” He said the project was revised to reduce costs and still meet ADA goals by leveling ground rather than constructing a full ramp.
The lawsuit alleges the ADA ramp plans were gradually replaced with an expanded patio and walkway, completed in time for the wedding, while the original ramp was never built.
Shepard maintains he personally paid the university for wedding-related venue costs and that the patio in question is part of the official presidential residence, regularly used for university events.
The Ethics Commission is seeking civil penalties and reimbursement for the cost of building a proper ADA-compliant ramp.
