DEMING – SANTA FE – On Monday, U.S. District Judge James Browning upheld New Mexico’s Waiting Period Act, maintaining the state’s seven-day waiting period for firearm purchases. Gov. Michelle Lujan Grisham expressed support, stating the decision affirms the law’s constitutionality and contributes to community safety by reducing impulsive gun violence and ensuring thorough background checks.
The law, signed by Gov. Lujan Grisham on March 4, 2024, requires a seven-day waiting period for all firearm purchases. The National Rifle Association’s attempt to block the law was rejected by Judge Browning, allowing the waiting period to remain in effect during litigation.
The waiting period addresses the “Charleston loophole,” which permits gun transfers by default after three business days without a completed federal background check. Exemptions to the law include concealed carry permit holders, federal firearms licensees, law enforcement transactions, and immediate family members.
